Migrated topic.
Both S. divinorum and salvinorin A are schedule I in Colorado. No exemptions for cultivation. Seems weird that vendors haven't added Colorado to their "cannot ship" list yet.

Here's the relevant bill from the Colorado state senate: http://www.state.co.us/gov_dir/leg_dir/olls/sl2011a/sl_261.htm

SENATE BILL 11-134 ...

Concerning the addition of certain drugs to the statutory list of schedule I controlled substances.

SECTION 1. 18-18-102 (5), Colorado Revised Statutes, is amended, and the said 18-18-102 is further amended BY THE ADDITION OF THE FOLLOWING NEW SUBSECTIONS, to read:

(5) "Controlled substance" means a drug, substance, or immediate precursor included in schedules I through V of part 2 of this article, including cocaine, marijuana, and marijuana concentrate, any synthetic cannabinoid, and salvia divinorum...

(33.5) "Salvia divinorum" means salvia divinorum, salvinorin A, and any part of the plant classified as salvia divinorum, whether growing or not, including the seeds thereof, any extract from any part of the plant, and any compound, manufacture, salts, derivative, mixture, or preparation of the plant, its seeds, or its extracts...

SECTION 2. Part 4 of article 18 of title 18, Colorado Revised Statutes, is amended BY THE ADDITION OF THE FOLLOWING NEW SECTIONS to read:

18-18-406.1. Unlawful use or possession of synthetic cannabinoids or salvia divinorum. (1) On and after January 1, 2012, it is unlawful for any person to use or possess any amount of any synthetic cannabinoid or salvia divinorum...

18-18-406.2. Unlawful distribution, manufacturing, dispensing, sale, or cultivation of synthetic cannabinoids or salvia divinorum. (1) It is unlawful for any person knowingly to:

(a) Manufacture, dispense, sell, or distribute, or to possess with intent to manufacture, dispense, sell, or distribute, any amount of any synthetic cannabinoid or salvia divinorum;

(b) Induce, attempt to induce, or conspire with one or more other persons, to manufacture, dispense, sell, distribute, or possess with intent to manufacture, dispense, sell, or distribute, any amount of any synthetic cannabinoid or salvia divinorum; or

(c) Cultivate salvia divinorum with intent to dispense, sell, or distribute any amount of the salvia divinorum...

Cite a source please. I've already shown the legislation (senate bill 11-134) where the state of Colorado added it to their list of schedule I substances. That bill passed in June 2011 and went into effect January 2012. Searching www.state.co.us for "salvia divinorum" turns up no legislation where that law has been repealed.

Considering the liberal attitudes in Colorado, and the fact that S. divinorum doesn't occasion much public outcry, I would not be surprised if Colorado law enforcement has chosen not to enforce the law. But unless you can provide any evidence that the legislation I linked to has been repealed, the language of that bill is clear: Salvia divinorum and salvinorin A are schedule I substances in Colorado.

best get on that and cultivate it colorado people. At some point it might not be so easy to obtain it if it's already scheduled.

......[Entropymancer]...

You very well could be right!.... but my suplyer says Colorado is ok to ship to>??
and has always shiped it fast!
I know that salvias Divinorums existance in USA is under constant threat...
And I think they ..[those in the government].. may want us all to become [juicers].or [drunks?]
So I agree that I and others should look into planting our own sometime in the future...

That wiki article cites the exact same source that I posted. S. divinorum and salvinorin A are schedule I; possession of them is a class 2 misdemeanor. Details on other offenses (manufacture/distribution/etc.) are in the link I posted above.

No mentuon of Colorado, even for salvia extracts on every site. There has to have been some recent change in the laws. I can't find a recent document though. Idk I really want a plant though.
*sigh* That a supplier does not mention that they cannot ship to Colorado does not mean it is legal. The law is above any supplier and you should be aware of that. Like Entropymancer stated several times by now: S. divinorum and salvinorin A are schedule I in Colorado, being in possession of it means you are breaking the law.

Also, please reread the Attitude and try to understand the reasoning behind the rules mescaline-man, this is the last time you will only be warned by me, nest time it's suspension.

Ok I do remember reading that salvia divinorum is considered illeagel at some level..
But being illeagle and being scedualed is two diferent things..
in Colorado ..but I have never seen salvia D..[called scedual 1].. in colorado yet...
From what ive read.. Colorado is treating posesion of salvia more like a misdomener offense like drinking under age or suplying booze to underaged people...
After all posession of salvia in colorado is [[a class 2 misdomener]] and that doesnt sound like a penalty for [sceduall one posession?...]
If it is sceduled...they must have done it very recently...
Also to request about my suplyer..i cant talk about in on this site ..all i can say is if they are willing to ship to you..get it while you can!.. and buy some cuttings and start your own garden..
I plan a S..D garden in the future..

How so? I think you need to familiarize yourself with American drug laws and schedules.

in Colorado ..but I have never seen salvia D..[called scedual 1].. in colorado yet...
Have you still not read the link I posted? S. divinorum is a schedule I drug in Colorado.

From what ive read.. Colorado is treating posesion of salvia more like a misdomener offense like drinking under age or suplying booze to underaged people...
Yes, simple possession of S. divinorum in Colorado is a misdemeanor. Do you know what a misdemeanor is? It's a criminal act, just one that is not as severe as a felony.

After all posession of salvia in colorado is [[a class 2 misdomener]] and that doesnt sound like a penalty for [sceduall one posession?...]
Again, have you still not read the link I posted? It says that the simple possession of the schedule I drug S. divinorum is a class 2 misdemeanor.

If it is sceduled...they must have done it very recently...
Again, have you still not read the link I posted? The law passed in 2011 and went into effect January 2012.

The question of the legal status of S. divinorum is a simple factual question. And it has a simple factual answer, which I've indicated several times. What you feel ought to be true is completely irrelevant. If you can't produce any evidence for your assertions, please don't bother making them.

And on a sidenote, would a quick spellcheck kill ya? We don't expect perfect spelling, grammar, or punctuation on this forum... but it looks like you spilled alphabet soup on your posts, which makes them difficult to read.
